Terms of Use
Article 1 Purpose
These Terms of Use aim to regulate all matters regarding the terms of use and operation of the services of "CLYVE Plastic Surgery" (hereinafter referred to as "the Site").
Article 2: Definition of Terms
Definitions of key terms used in these Terms and Conditions are as follows.
① Member: Refers to a user who has agreed to the site's terms, provided personal information for registration, entered into a service agreement, and uses the site.
② Service Agreement: Refers to the contract concluded between the site and the member regarding the use of the site.
③ Member ID (hereinafter "ID") : Refers to a unique combination of letters and numbers assigned to each member for identification and service use.
④ Password: Refers to a combination of letters and numbers selected by the member to confirm that the member matches the assigned ID and to protect the member's rights.
⑤ Operator: Refers to the operator who opens and operates a homepage on the service.
⑥ Termination: Refers to a member terminating the service agreement.
Article 3. Supplementary Rules to the Terms and Conditions
The operator may announce separate operating policies if necessary, and in case of overlap between these terms and operating policies, the operating policies shall take precedence.
Article 4 Conclusion of Service Agreement
① The service agreement is established by the operator's approval of use for those who wish to use the site by registering as a member, upon their agreement to these terms and conditions and application for membership.
② Those who wish to register as a member and use the service indicate their consent to these terms and conditions by reading them and selecting "I agree" below when applying for site membership.
Article 5 Service Use Application
① Users who wish to register as members and use the site must provide all requested information (User ID, password, nickname, etc.).
② Members who steal or misuse others' information, register false information, or do not register their true information cannot claim any rights related to the use of the site and may be punished according to relevant laws and regulations.
Article 6 Privacy Policy
The site and its operators do not possess the password among the personal information provided during membership registration, and related matters follow the site's privacy policy.
The operator endeavors to protect members' personal information, including registration details, in accordance with applicable laws.
Regarding the protection of members' personal information, we adhere to the personal information processing policy stipulated by relevant laws and regulations and the site.
However, the operator bears no responsibility whatsoever for information exposed due to reasons attributable to the member.
If a member posts illegal content that harms public morals or national security, the operator may view and submit the member's data to relevant authorities upon request.
Article 7 Operator's Obligations
① If the operator acknowledges that opinions or complaints raised by users are legitimate, they shall process them as quickly as possible. However, if prompt processing is difficult due to personal circumstances, the operator shall do their best by providing subsequent notice or sending messages, emails, etc., to the users.
② To ensure continuous and stable site service, the operator may request the site to promptly repair or restore equipment in the event of failure or data loss. However, site operation may be temporarily suspended due to natural disasters or unavoidable circumstances affecting the site or operator.
Article 8 Member's Obligations
① Members must comply with the provisions stipulated in these terms and conditions, all regulations, announcements, and operational policies set by the operator, as well as matters announced by the site and relevant laws and regulations. Furthermore, members must not engage in any acts that interfere with the site's operations or damage its reputation.
② Members may not, without the explicit consent of the site, transfer or donate their right to use the service or any other status under the terms of use to a third party, nor may they offer it as collateral.
③ Users must exercise considerable care in managing their ID and password, and may not provide their ID to a third party for use without the consent of the operator or site.
④ Members must not infringe the intellectual property rights of the operator, site, or third parties.
Article 9 Service Usage Hours
① In principle, service hours are 24 hours a day, year-round, unless there are special business or technical impediments. However, the site may temporarily suspend services on dates or times set by the site for regular system inspections, expansion, and replacement. Temporary suspension of services due to scheduled work will be announced in advance on the site's homepage, so please refer to it frequently.
② However, the site may temporarily or permanently suspend services without prior notice or warning in the following cases.
- In case of urgent system inspection, expansion, replacement, failure, or malfunction
- When there is a force majeure reason such as a national emergency, power outage or natural disaster
- If a telecommunications carrier, as stipulated in the Telecommunications Business Act, has suspended telecommunications services
- In cases where normal service use is hindered due to a surge in service usage, etc.
③ In the event of service suspension due to the preceding paragraph, the site shall notify members in advance through notices. However, if prior notice is not possible for service suspensions caused by reasons beyond the site's control, a post-notice will suffice.
Article 10 Service Termination
① If a member wishes to terminate the user agreement with the site, the member must apply for registration termination online. Separately from site usage termination, the user agreement for the site must be terminated separately.
② Upon application for termination, site-related programs provided by the site are automatically deleted from the member management screen, and the operator can no longer view the information of the termination applicant.
Article 11 Restriction on Service Use
Members shall not engage in any of the following acts, and if a member engages in such an act, the site may restrict the member's use of the service, take appropriate measures, terminate the service agreement, or suspend the service for a specified period.
① Registering false information when signing up or when changing information after signing up
② Acts that interfere with others' use of the site or steal information.
③ Impersonating the site's operators, employees, or related parties
④ Acts that infringe on the personality rights or intellectual property rights of the site or other third parties, or interfere with business operations.
⑤ Acts of fraudulently using another member's ID.
⑥ Collecting, storing, or disclosing personal information about other members without their consent
⑦ Acts objectively deemed to be related to criminal activity
⑧ Other acts that violate relevant laws and regulations.
Article 12: Management of Posts
① The administrator is responsible for the management and operation of the site's posts and data. The administrator must always monitor for inappropriate posts and data, and if inappropriate posts or data are found or reported, they must delete the relevant posts and data and warn the member who registered them.
Meanwhile, users are solely responsible for the content they upload, and members must not post content that violates these terms of service.
② In the event of a corrective request from a public institution such as the Korea Communications Standards Commission, the operator may delete or move posts without the member's prior consent.
③ The criteria for judging inappropriate posts are as follows.
- In cases where the content severely insults or damages the reputation of other members or third parties
- In cases of distributing or linking content that violates public order and morals
- In case of content that promotes illegal copying or hacking
- In the case of advertisements for commercial purposes
- When the content is objectively recognized as being connected to a crime
- If another user or a third party infringes on copyrights or other rights
- If it is deemed to violate other relevant laws and regulations
④ The site and its operators may temporarily suspend a post (or transmission) if they receive a request from a third party to do so due to infringement of rights such as defamation or intellectual property rights. They will comply if a lawsuit, settlement, or other similar decision by a relevant institution is reached between the suspension requester and the post registrant and submitted to the site.
Article 13 Retention of Posts
If the site operator has to discontinue this site due to unavoidable circumstances, we will provide prior notice to members and strive to take all measures to facilitate the transfer of posts.
Article 14 Copyright for Posts
① The copyright of posts published by members on the site belongs to the member who posted them. Furthermore, the site may not use posts for commercial purposes without the poster's consent. However, this does not apply to non-profit purposes, and the site retains the right to publish within the service.
② Members may not commercially use materials posted on the service, including arbitrarily processing or selling information obtained through the service.
③ The operator may delete, move, or refuse registration of content and posts on the site that members post or register, without prior notice, if it is determined to fall under each subparagraph of Article 12.
Article 15 Compensation for Damages
① All civil and criminal liabilities arising from this site primarily rest with the member themselves.
② No compensation for damages will be made if damages incurred by a member from this site are due to force majeure such as natural disasters, or caused by the member's intent or negligence.
Article 16 Disclaimer.
① The operator is exempt from liability if a member does not obtain the expected benefits from the site's service provision, or for damages arising from the selection or use of service materials.
② The operator is exempt from liability in cases of service failures caused by the service infrastructure of this site or telecommunication services provided by other telecommunication providers, and any damages incurred in relation to the service infrastructure of this site are subject to the site's terms of use
③ The operator shall not be held liable for any data stored, posted, or transmitted by the member.
④ The operator is not responsible for any service disruptions caused by reasons attributable to the member.
⑤ The operator is not responsible for any activities (including data transmission and other community activities) between members, between members and third parties, or any other activities of members, whether within or outside this service.
⑥ The operator is not responsible for the authenticity, reliability, accuracy, or any other content of materials posted or transmitted by members, or any materials provided to members through this site.
⑦ The operator is not responsible for any damages arising from transactions of goods, etc., conducted between members or between members and third parties through the service.
⑧ The operator shall not be liable for any disputes arising between members or between a member and a third party without fault attributable to the operator.
⑨ The operator is not responsible for any damages incurred by members due to system failures that may occur without willful intent or gross negligence during the management, inspection, maintenance, replacement of servers and other equipment, or during software operation, system failures caused by third-party attacks, the spread of computer viruses for which countermeasures have not been developed by renowned domestic and international research institutions or security-related companies, or other force majeure events beyond the operator's control.
